Welcome to Aces Airboat Tours ("Aces," "we," "us" or "our"). These Terms of Service ("Terms") govern your use of our website at acesairboattours.com and your booking and participation in our Everglades airboat tours and related services. By booking a tour, using our website, or riding with us, you agree to these Terms. If you do not agree, please do not book a tour or use the site.

1. Booking & Reservations

Tours are booked directly with us by text or phone with Captain Billy at 561-660-2419. When you book, you agree to provide accurate, complete information and you confirm that you are at least 18 years old, or that a parent or legal guardian is booking on your behalf. A reservation is not confirmed until you receive a confirmation from us. Tour times, availability, pricing and routes are subject to change based on weather, water conditions, seasonal factors and captain discretion.

2. Payment & Pricing

Prices are quoted in U.S. dollars and are subject to change without notice. Payment is arranged directly with us when you book. You are responsible for any taxes, fees or gratuities that apply. Gratuities for your captain are appreciated but never required.

3. Cancellations, Rescheduling & Refunds

Weather in South Florida moves fast, and we will never send you out in unsafe conditions. If weather or water conditions affect your tour, we will work with you to reschedule so you still get your ride. Full details on notice periods, weather cancellations, no-shows and refunds are covered in our Cancellation & Refund Policy, which is incorporated into these Terms by reference.

4. Safety, Waivers & Assumption of Risk

Airboat tours take place on natural, wild Everglades waterways. Participation involves inherent risks, including but not limited to exposure to sun, heat, wind, water, loud engine noise, wildlife (including alligators and other animals), uneven surfaces and the general hazards of boating and outdoor activity. By participating, you voluntarily assume these risks.

Every guest must follow all captain instructions and safety briefings at all times. We provide hearing protection and a safety briefing before each ride, and we require that you wear and use provided safety equipment. All guests may be required to sign a liability waiver and release before boarding. Refusal to follow safety instructions or sign a required waiver may result in denial of boarding without a refund.

5. Minors & Guest Eligibility

Children are welcome on most of our tours and must be accompanied by a parent or legal guardian who is responsible for their supervision and safety at all times. A parent or guardian must sign any required waiver on behalf of a minor. For the safety of all guests, we reserve the right to refuse service to anyone who appears to be under the influence of alcohol or drugs, who behaves in a manner that endangers others, or who cannot safely participate in the activity.

6. Guest Conduct

You agree to conduct yourself responsibly, to respect the Everglades ecosystem and its wildlife, and to comply with all applicable laws and regulations. Do not feed, bait, touch or harass wildlife. Do not litter or remove plants, animals or artifacts from the environment. Disruptive, unsafe or unlawful behavior may result in immediate removal from the tour without a refund.

7. Photography & Media

We may photograph or record tours for our own promotional purposes. By participating, you consent to the use of your likeness in such media unless you notify your captain in writing before the tour that you do not wish to be included.

8. Limitation of Liability

To the fullest extent permitted by law, Aces Airboat Tours, its owners, captains, employees and agents shall not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of our website or participation in our tours. Nothing in these Terms limits liability that cannot be limited under applicable law. Our tours are offered subject to any separately signed liability waiver, which controls in the event of a conflict.

9. Website Use & Intellectual Property

The content on acesairboattours.com — including text, images, logos and design — is owned by or licensed to Aces Airboat Tours and is protected by applicable intellectual property laws. You may not copy, reproduce or redistribute our content without permission. We provide the website "as is" and make no warranties about its accuracy, availability or fitness for any purpose.

10. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use and protect your information.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Broward or Palm Beach County, Florida.
